## The law {#laws}

### Florida automatic renewal of service contracts {#florida-automatic-renewal-of-service-contracts}

- **Citation:** [Fla. Stat. § 501.165](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599/0501/Sections/0501.165.html)
- **Effective:** 2010-07-01
- **Status:** In force
- **Verified:** 2026-10-29, official text read in full (confidence: high)

Service contracts with automatic renewal provisions: clear and conspicuous disclosure; 30-60 day notice before the cancellation deadline for 12-month+ contracts renewing for more than a month; cancellation by the same means as acceptance. Violations void the renewal provision.

**Scope:** Service contracts only. Exempt: financial and depository institutions (and affiliates), health studios, entities licensed under chs. 624, 627, 634, 636 or 641, electric utilities, and certain ch. 180 private utility companies.

| Amendment | Effective | Change |
|---|---|---|
| Ch. 2022-169, Laws of Fla. (CS/CS/CS/HB 749) | 2022-06-03 | Same-manner, same-means cancellation. |

## Requirements {#requirements}

Each row is one obligation in the catalog, in plain English, with the provision it comes from. "Applies when" lists the conditions under which it applies (otherwise it always applies to covered offers). The ids are stable and match the [dataset](https://checkbox.site/laws/data) and Checkbox API results.

### At sign-up {#signup}

| Requirement | Applies when | Effective | Citation |
|---|---|---|---|
| **Disclose the automatic renewal provision clearly and conspicuously in the contract or offer** A seller of a service contract with an automatic renewal provision must disclose the provision clearly and conspicuously in the contract or contract offer. <br>`US-FL.501.165.2.a` | term ≥ 2 months | 2010-07-01 | [Fla. Stat. § 501.165(1)(a), (2)(a)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599/0501/Sections/0501.165.html) |

### Before charges (notices and reminders) {#reminder}

| Requirement | Applies when | Effective | Citation |
|---|---|---|---|
| **Renewal notice 30-60 days before the cancellation deadline for 12-month+ service contracts** For a service contract with a term of 12 months or more that renews for more than one month, give written or electronic notice of the automatic renewal provision 30 to 60 days before the cancellation deadline, disclosing clearly and conspicuously that the contract will renew unless cancelled and how to obtain details of the renewal provision and the cancellation procedure. <br>`US-FL.501.165.2.b` | term ≥ 12 months | 2010-07-01 | [Fla. Stat. § 501.165(2)(b)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599/0501/Sections/0501.165.html) |

### Cancelling {#cancellation}

| Requirement | Applies when | Effective | Citation |
|---|---|---|---|
| **Allow cancellation in the same manner and by the same means as acceptance** A seller that enters into or renews a service contract with an automatic renewal provision must allow the consumer to cancel in the same manner, and by the same means, as the consumer accepted the contract. <br>`US-FL.501.165.2.d` | term ≥ 2 months | 2022-06-03 | [Fla. Stat. § 501.165(2)(d)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599/0501/Sections/0501.165.html) |

## Notice windows {#notice-windows}

When each notice must be sent. A notice outside its window does not count, so schedule sends against the exact dates.

| Notice | When | Applies when | Citation |
|---|---|---|---|
| Renewal notice 30-60 days before the cancellation deadline for 12-month+ service contracts | 30-60 days before the cancellation deadline | term ≥ 12 months | [Fla. Stat. § 501.165(2)(b)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599/0501/Sections/0501.165.html) |

Several states use overlapping windows; one email can often satisfy all of them. See [free-trial notices](https://checkbox.site/docs/learn/free-trial-notices) and [price increases](https://checkbox.site/docs/learn/subscription-price-increases).

## Who can sue, and remedies {#enforcement}

**Private right of action:** Indirectly: private suits go through general consumer-protection law.

Remedy: the automatic-renewal provision is void / unenforceable; whether this "service contract" law reaches digital subscriptions at all is unsettled (open question 16); private enforcement through the state's general consumer-protection (UDAP) statute is inferred, not verified.

Remedy figures come from the cited statutes and from public enforcement records summarized in Checkbox's litigation research; figures from secondary sources are marked "unverified" where they appear.

## Check your subscription flow {#check}

Checkbox evaluates these requirements automatically: the sign-up page, the emails and the cancellation flow are checked against Florida's rules (and every other jurisdiction's) on every check. 6 machine checks cover this page: `signup.disclosure.autorenew_language`, `signup.disclosure.conspicuous`, `reminder.annual_renewal`, `cancel.online_available`, `cancel.mechanism_findable`, `config.portal_cancel_enabled`.

- Free to start: [get test API keys](https://app.checkbox.site/sign-up) or connect the MCP server at `https://app.checkbox.site/mcp` from your coding assistant.
- Preflight a disclosure, a Stripe Checkout Session or an email before you ship: [preflight checks](https://checkbox.site/docs/preflight) (`--jurisdictions US-FL` limits a check to Florida's rules).
- Start from the [subscription compliance checklist](https://checkbox.site/docs/learn/subscription-compliance-checklist).
